雇员忠诚保险

雇员忠诚保险单
兹因本保险单附表所列雇主凭书面投保单及有关函件(均应作为本合同及以后续保的基础,并应视为本保险单的一部分)向本保险单签署人(以下称本公司)申请担保附表所列雇员的忠诚。
本公司特证明,根据本保险单的条款和险别或有关的批单或保险单其他措辞,及付给本公司附表规定的保费,本公司同意赔付雇主由于附表所列任何一名或一名以上雇员在下述情况下:
(1)附表规定的赔偿期内;及
(2)在上述雇员不中断的雇佣期间;及
(3)和上述雇员有关的职业和职责中。
因欺骗或不忠实行为而遭受的直接经济损失。
但本公司对下列各项不负责任:
(1)有关雇员欺骗或不诚实的任何行为,除非前述行为在上述赔偿期内或赔偿期后六个月内或在雇员死亡、被解雇或退休后六个月内发现,上述以首先发生者为准;
(2)如果雇主的营业性质或雇佣的职责或条件发生变更,或者没有本公司的认可,减少雇员的报酬,或者保证帐目准确性的预防措施和检查没有切实遵守;
(3)高于赔偿期的总赔偿限额的数额。
又,雇主应该遵守及履行本保险单及批单有关雇主应做的或应予遵守的条款及规定以及投保单内真实的陈述和回答。

条    件
1对本公司的一切通知或通信,都应以书面送至浙商财产保险股份有限公司。除非用书面方式,否则有关本保险单任何事项或有关本保险单项下任何索赔的通知或消息,不应视为对本公司的通知或为本公司所获知。
2一经得知导致或可能导致在本保险单项下索赔的任何情况,雇主或其代表(如果知道)应立即通知本公司说明雇员的下落及当时所发现的欺骗行为的细节,并应在上述通知后三个月内提交本公司索赔的全部细节,并提供索赔的证据。
3如果发生索赔,雇主的所有帐册及其有关任何会计报告应公开由本公司检查。雇主应给予一切消息和帮助,以便本公司用以向雇员或在其资产中取得对本公司在本保险单项下已付或必须负责支付的任何金额的补偿。
4本公司需要时(取得罪证时由本公司支付费用),雇主应积极向雇员主张权利。
5雇员在雇主手中的钱以及如无欺骗或不忠实行为雇主本应付给雇员的钱,应从本保险单项下支付的赔款中扣除。
6在本保险单项下发生索赔时,如另有其他关于雇员行为或欺骗的担保或保证,本公司对索赔仅负责赔偿或分摊应赔付的比例部分。
7本公司在七天内以挂号信按其最近获悉的地址通知雇主注销本保险单。在此情况下,本公司将按比例退回未到期部分的保险费。雇主可在七天内通知本公司注销本保险单。在此情况下,雇主有权获得减去保险已生效的时期按本公司短期费率所支付的保费后的退费。
8雇主应在雇佣所有雇员前向其先前的雇主进行查询。查清其诚实情况,是本公司在保险单项下承担任何责任的先决条件。这项查询材料应由雇主保存。索赔时应提交本公司。
9雇主与本公司之间在本保险单项下的所有争议,应通过友好协商解决。如果双方协商后未达成协议。争议应提交保险单载明的仲裁机构,如保险单未载明仲裁机构且争议发生后未达成仲裁协议的,依法向人民法院起诉。
10本公司在任何情况下都不负责赔偿从发生损失时起十二个月后的任何损失。除非索赔尚在法院审理或仲裁中。
短期费率表:
保险期间不足1年的,应按照下述比例计算短期保险费:

FIDELITY CLAUSES
Whereas the Employer described in the Schedule hereto by a written proposal and declaration which together with any correspondence relative thereto shall be the basis of this contract and of every renewal and is deemed to be incorporated herein has applied to the undersigned (hereinafter called “the Company")to guarantee the fidelity of the Employees described in the Schedule.
Now this Policy witness that subject to the terms and conditions contained herein or endorsed or otherwise expressed hereon and in consideration of the payment to the Company of the premium stated in the Schedule.
The Company agrees to make good and reimburse to the Employer all such direct pecuniary loss as the Employer shall sustain by any act of fraud or dishonesty committed by any one or more of the Employees as described in the Schedule.
(1) during the Period of Indemnity stated in the Schedule and
(2) during the uninterrupted continuance of employment of the said Employees and
(3) in connection with the Occupation and Duties of the said Employees.
Provided always that the Company shall not be liable:
(1) In respect of any act of fraud or dishonesty committed by the Employee unless such act of fraud or dishonesty is discovered during the aforesaid Period of Indemnity or within six months thereafter or within six months after the death dismissal or retirement of the Employee whichever event shall first happen;
(2)If the nature of the business of the Employer or the duties or conditions of employment be changed or the remuneration of the Employee reduced without the sanction of the Company or if the precautions and checks for securing accuracy of accounts shall not be duly observed;
(3) To pay more than the Aggregate Limit for the Period of Indemnity.
Provided further that the due observance and fulfillment of the terms conditions and endorsements of this Policy in so far as they relate to anything to be done or complied with by the Employer and the truth of the statements and answers in the said proposal.

CONDITIONS
1. Every notice or communication to the Company shall be in writing and sent to Zheshang Property & Casualty Insurance Company Limited., and notice or knowledge of anything relating to this Policy or any claim hereunder shall not be deemed to be notice to or within the knowledge of the Company unless so given.
2. Immediately the Employer shall become aware of any circumstances giving rise or likely to give rise to a claim under this Policy the Employer or his representative shall immediately give notice thereof to the Company stating if known the whereabouts of the Employee and particulars of the acts of defaults then discovered and shall within three months after such notice deliver to the Company full details of the claim and shall furnish proof of the correctness of such claim.
3. In the event or claim all books of accounts of the Employer and any accountant reports thereon shall be open to the inspection of the Company and the Employer shall give all information and assistance to enable the Company to use for and obtain reimbursement by the Employee or his estate of any moneys which the Company shall have paid or become liable to pay under this Policy.
4. The Employer should exercise right actively if and when required by the Company but at the expense of the Company.
5. Any moneys of the Employee in the hands of the Employer and any moneys which but for any act of fraud or dishonesty would have been due to the Employee from the Employer shall be deducted from the amount otherwise payable under this Policy.
6. If at the time of any claim arising under this Policy there be any other subsisting guarantee or security in respect of the acts or defaults of the Employee the Company shall not be liable to pay or contribute more than its rateable proportion of such claim.
7. This Policy may be cancelled at any time by 7 days notice by registered letter from the Company to the Employer’s last known address and in such event the Company will return a pro-rata portion of the premium for the unexpired part of the Period of Indemnity. This Policy may be cancelled at any time by the Employer on 7 days notice to the Company and in such event the Employer shall be entitled to a return of the premium less premium at the Company’s Short Period Rates for the time the Policy has been in force during the then current period of insurance.
8. It is a condition precedent to any liability on the part of the Company under this Policy that the Employer shall satisfy himself with the integrity of all Employees prior to their engagement by taking up references with their former employers. Such references shall be retained by the Employer and in the event of a claim shall be produced to the Company.
9. All disputes arising between the Employer and the Company under this Policy shall be settled through friendly negotiations. Where both sides fail to reach a settlement after negotiations, such dispute shall be submitted to arbitration or to court for legal action.
10. In no case whatever shall the Company be liable for any loss after the expiration of twelve months from the happening of the loss unless the claim is the subject of pending court action or arbitration.
